On April 21, 2010, the Ministry of Commerce of the People's Republic of China (the "MOFCOM") issued Announcement No.15 of 2010, deciding to levy anti-dumping duties against imports of Polyamide-6 granula (the "PA6") originated in the United States, the EU, Russia and Taiwan Region. On April 21, 2016, the MOFCOM issued Announcement No.4 of 2016, deciding to maintain the foregoing anti-dumping measures for five years. Among them, the anti-dumping duty rate applicable to Honeywell Resins & Chemicals LLC was 36.2% and that for other US companies, 96.5%.
On October 18, 2011, the MOFCOM issued Announcement No.68 of 2011, deciding to levy anti-dumping duties against imports of caprolactam originating in the EU and the United States. On
October 21, 2017, the MOFCOM issued Announcement No.53 of 2017, deciding to maintain the foregoing anti-dumping measures for five years. Among them, the anti-dumping duty rate applicable to Honeywell Resins & Chemicals LLC was 3.6% and that for other US companies, 24.2%.
On December 27, 2017, AdvanSix Resins & Chemicals LLC filed an application with the MOFCOM, stating that in order to go public, the name of Honeywell Resins & Chemicals LLC had been changed to AdvanSix Resins & Chemicals LLC and requesting for inheritance of the anti-dumping duty rates under the anti-dumping measures for PA6 and caprolactam by the latter. Also, it submitted shareholder resolutions, articles of association before and after the change of name, registration documents, list of officers, production capacity, raw material suppliers and clients, certification documents of the Embassy of the People's Republic of China in the United States and other relevant supporting documents.
The MOFCOM has notified PA6 industry and caprolactam industry of China in regard to the above application. Within the specified time, the related industries did not raise objections.
After examination, the MOFCOM concluded that the existing materials show that the change of name of Honeywell Resins & Chemicals LLC complies with its relevant legal provisions and there were no changes in the operation and management, production capacity, supplier relations, customer base and others regarding PA6 and caprolactam before and after the name change.
Thus, the MOFCOM hereby decides that:
I. AdvanSix Resins & Chemicals LLC will inherit the anti-dumping duty rate applicable to Honeywell Resins & Chemicals LLC under the anti-dumping measures imposed on PA6, 36.2% and other rights and obligations. PA6 products exported to mainland China in the name of Honeywell Resins & Chemicals LLC will be subject to anti-dumping duty at a rate of 96.5% that is applicable to other US companies under the anti-dumping measures imposed on PA6.
II. AdvanSix Resins & Chemicals LLC will inherit the anti-dumping duty rate applicable to Honeywell Resins & Chemicals LLC under the anti-dumping measures imposed on caprolactam, 3.6% and other rights and obligations.Caprolactam products exported to mainland China in the name of Honeywell Resins & Chemicals LLC will be subject to anti-dumping duty at a rate of 24.2% that is applicable to other US companies under the anti-dumping measures imposed on caprolactam.
MOFCOM Announcement No.47 of 2018 on AdvanSix Resins & Chemicals LLC Inheriting the Anti-dumping Duty Rate under the Anti-dumping Measures Imposed on Polyamide-6 Granula and Caprolactam Applicable to Honeywell Resins & Chemicals LLC will take effect as of June 9, 2018.
