MOFCOM Announcement No.50 of 2017 on Ruling of the Midterm Review of Dumping and Dumping Margin of Anti-dumping Measures Against Imports of Carbon Steel Fasteners Originated in Koninklijke Nedschroef Holding B.V. (Netherlands)

On June 28, 2010, the Ministry of Commerce of the People's Republic of China (the “Investigation Authority”) issued Announcement No.40, deciding to conduct anti-dumping measures against imports of carbon steel fasteners originated in the EU for 5 years from June 29, 2010.

On June 28, 2016, the Investigation Authority issued Announcement No.24, deciding to maintain the anti-dumping measures imposed on carbon steel fasteners originated in the EU for five years.

On July 28, 2016, the domestic importer Nedschroef Fasteners (Kunshan) Co., Ltd. applied to the Investigation Authority, stating that after the validity of the anti-dumping measures, the normal value and export price of carbon steel fasteners from Koninklijke Nedschroef Holding B.V. (Netherlands) changed so there is no need to continue levying anti-dumping measures at the original rates, and therefore applying for a midterm review of dumping and dumping margin of the anti-dumping measures against imports of carbon steel fasteners originated in Koninklijke Nedschroef Holding B.V. (Netherlands)

The Investigation Authority believes that the case-filing conditions are met after reviewing the applications according to the law. According to the Anti-dumping Regulations of the People's Republic of China and the Provisional Rules on Midterm Review of Dumping and Dumping Margin issued by the Ministry of Commerce, the Investigation Authority announced on September 20, 2016 to conduct midterm review of dumping and dumping margin of the anti-dumping measures applicable to imports of carbon steel fasteners originated in Koninklijke Nedschroef Holding B.V. (Netherlands) (the "Product under Investigation").

According to the results of the review of dumping and dumping margin of the Product under Investigation, the Investigation Authority recommended the implementation of anti-dumping measures to the Customs Tariff Commission of the State Council. In accordance with Article 50 of the Anti-dumping Regulations of the People's Republic of China and the decision of the Customs Tariff Commission of the State Council, related matters are announced as follows:

I. Review Ruling

After investigation, the Investigation Authority ruled that the carbon steel fasteners imported from Koninklijke Nedschroef Holding B.V. (Netherlands) and its affiliates are subject to dump during the review investigation period.

II. Anti-dumping Measures

According to the relevant provisions of Anti-dumping Regulations of the People's Republic of China, the Customs Tariff Commission of the State Council decided that since September 20, 2017, anti-dumping tax rate on carbon steel fasteners imported from Koninklijke Nedschroef Holding B.V. and its affiliates is adjusted to 5.5%.

Specific descriptions of the product subject to anti-dumping duty are consistent with those set out in the MOFCOM Announcement No.40 of 2010 and No.24 of 2016.

Rates of anti-dumping duty imposed on related companies are as follows:

Nedschroef Altena GmbH 5.5%
Nedschroef Fraulautern GmbH 5.5%
Nedschroef Helmond B.V. 5.5%
Nedschroef Barcelona SAU 5.5%
Nedschroef Beckingen GmbH 5.5% 

III. Methods of Levying Anti-dumping Duties

As of September 20, 2017, import operators shall pay relevant anti-dumping duties to the Customs of the People’s Republic of China when importing carbon steel fasteners originated in the abovementioned companies. The anti-dumping duties shall be levied by means of ad valorem on the basis of dutiable value authorized by China Customs, and the formula is: Anti-dumping duties = dutiable value authorized by China Customs x rate of anti-dumping duties. The import value-added tax shall be levied by means of ad valorem with the dutiable value authorized by China Customs plus the tariff and anti-dumping duties as the taxable value.

IV. Administrative Reconsideration and Administrative Litigation

Any person who refuses to accept the review may, according to Article 53 of the Anti-dumping Regulations of the People's Republic of China, apply for an administrative reconsideration or initiate a litigation to the people's court according to the law.

V. The MOFCOM Announcement No.50 of 2017 on Ruling of the Midterm Review of Dumping and Dumping Margin of Anti-dumping Measures Against Imports of Carbon Steel Fasteners Originated in Koninklijke Nedschroef Holding B.V. (Netherlands) will take effect as of September 20, 2017.
