MOFCOM Announcement No.49 of 2017 on Expiry of Part of Anti-dumping and Countervailing Measures in the First Half of 2018

According to Article 48 of the Regulations of the People's Republic of China on Anti-dumping, the levying period of anti-dumping duties and the fulfillment period of price undertakings shall not exceed 5 years; but, if it is determined upon review that the termination of levying the anti-dumping duties may result in the continuity or resumption of the dumping and damages, the levying period of the anti-dumping duties may be extended properly. According to Article 47 of the Countervailing Regulation of the People's Republic of China, the levying period of countervailing duties and the fulfillment period of undertakings shall not exceed 5 years; but, if it is determined upon review that the termination of levying the countervailing duties may result in the continuity or resumption of the subsidies and damages, the levying period of the countervailing duties may be extended properly. With the view of making interested parties learn about the periods of the measures in a timely manner, the Ministry of Commerce hereby announces the anti-dumping and countervailing measures, which will expire from January 1, 2018 to June 30, 2018, as below:

I. The anti-dumping and countervailing measures, which will expire from January 1, 2018 to June 30, 2018, are hereby announced (see the appendix) via the MOFCOM Announcement No.49 of 2017 on Expiry of Part of Anti-dumping and Countervailing Measures in the First Half of 2018 (hereinafter referred to as the "Announcement"). The Ministry of Commerce will not announce the expiry of such measures of any case again.

II. If any natural person, legal person or relevant organization of the relevant domestic industry or on behalf of the relevant domestic industry, 60 days before expiry of the anti-dumping and countervailing measures of a case specified in the appendix to the Announcement, believes that the termination of such measures may result in the continuity or resumption of the dumping/subsidies and damages, the said natural person, legal person or organization may make an written application for expiry review to the Ministry of Commerce.

III. The application for expiry review shall include the definite expression of the requirement for expiry review and evidentiary materials that the termination of the anti-dumping and countervailing measures may result in the continuity or resumption of the dumping/subsidies and damages.

IV. If no natural person, legal person or relevant organization of the relevant domestic industry or on behalf of the relevant domestic industry makes an application for expiry review in accordance with the Announcement, and before expiry of the relevant anti-dumping and countervailing measures, the Ministry of Commerce does not actively make an investigation of expiry review, the anti-dumping and countervailing measures will be terminated upon expiry thereof.
