Announcement No.36 [2017] of the Ministry of Commerce on the inheritance of the applicable anti-dumping duty rate on acrylic fibers from Mitsubishi Rayon Co., Ltd. by Mitsubishi Chemical Corporation in the anti-dumping measures

The Ministry of Commerce issued Announcement No.31 [2016] on July 13, 2016, and decided to impose anti-dumping duties on acrylic fibers imported from Japan, South Korea and Turkey, including the anti-dumping duty rate of 15.8% on the acrylic fibers imported from Mitsubishi Rayon Co., Ltd.

On June 15, 2017, Mitsubishi Chemical Corporation submitted to the Ministry of Commerce an application claiming that Mitsubishi Rayon Co., Ltd. merged with Mitsubishi Chemical Corporation (former Mitsubishi Chemical Corporation) and Mitsubishi Plastics, Inc. on April 1, 2017 and the new integrated corporation will continue business as Mitsubishi Chemical Corporation (new Mitsubishi Chemical Corporation), requested that the new integrated corporation should inherit the anti-dumping duty rate on acrylic fibers applicable to Mitsubishi Rayon Co., Ltd. and submitted the resolutions of shareholders' meeting, the certificate of change of the registration, the information on the shareholders, directors, production capacities, raw material providers and sales customers before and after the corporation name change, and the relevant evidentiary materials including the evidentiary documents authenticated by the local government and the embassy of the People's Republic of China in the country.

The Ministry of Commerce informed the domestic acrylic fiber industry of the matters related to the above-mentioned application and the domestic acrylic fiber industry did not raise any objection within the specified time period. Upon examining all the materials, the Ministry of Commerce believes that the existing evidentiary materials have indicated that the corporate name change of Mitsubishi Chemical Corporation conforms to the stipulations of the relevant Japanese laws, the operation management and production capacities of the acrylic fibers did not change after the corporate name was changed, and the relationship with the providers, the customer base and the management personnel did not change significantly after the corporate name was changed.

According to the above-mentioned information, the Ministry of Commerce has decided that Mitsubishi Chemical Corporation should inherit the anti-dumping duty rate of 15.8% on acrylic fibers and other rights and obligations from Mitsubishi Rayon Co., Ltd. The anti-dumping duty rate of 16.1% on acrylic fibers applicable to the other Japanese companies shall be applicable to the acrylic fibers exported to China in the name of Mitsubishi Rayon Co., Ltd.

The announcement shall be implemented as of August 5, 2017.
