MOFCOM Announcement No.14 of 2017 - Announcement on Public Joint Stock Company KuibyshevAzot Inheriting the Anti-dumping Duty Rate under the Anti-dumping Measures Imposed on Polyamide-6 Granula

On April 21, 2010, the Ministry of Commerce of the People's Republic of China (the “MOFCOM”) issued Announcement No.15 of 2010, deciding to levy anti-dumping duties against imports of Polyamide-6 granula (the "PA6") originated in the United States, the EU, Russia and Taiwan Region. On April 21, 2016, the Ministry of Commerce issued Announcement No.4 of 2016, deciding to maintain the foregoing anti-dumping measures for five years. Among them, the anti-dumping duty rate applicable to Russia Open Joint Stock Company KuibyshevAzot was 5.9% and that for other Russia companies, 23.9%.

On January 15, 2017, the Russian Public Joint Stock Company KuibyshevAzot applied to the Ministry of Commerce, stating that for the purpose of listing, the name of Open Joint Stock Company KuibyshevAzot was changed to Public Joint Stock Company KuibyshevAzot, and requesting the inheritance of the anti-dumping duty rate applicable to the original company under anti-dumping measures imposed on PA6 by the company after the change; and also submitted the resolution of the shareholders' meeting, the company's articles of association before and after the change of name, business license, registration documents, shareholders, directors, production capacity, suppliers of raw materials and client information and other supporting materials. On January 24, 2017, the company submitted the supporting documents and other relevant evidence authenticated by the Russian notary public and the embassy of the People's Republic of China in Russia.

The Ministry of Commerce has notified the PA6 industry of China in regard to the above application. Within the specified time, the domestic PA6 industry did not raise objections.

Upon review, in the opinion of the Ministry of Commerce, the existing evidence proves that Public Joint Stock Company KuibyshevAzot's name change conforms to the relevant laws and regulations, and there were no changes in the operation and management, production capacity, supplier relations, customer base and others regarding PA6 before and after the name change.

Thus, the Ministry of Commerce hereby decides that: the Public Joint Stock Company KuibyshevAzot will inherit the anti-dumping duty rate applicable to Open Joint Stock Company KuibyshevAzot under the anti-dumping measures imposed on PA6, 5.9% and other rights and obligations. PA6 products exported to China in the name of Open Joint Stock Company KuibyshevAzot will be subject to anti-dumping duty at a rate of 23.9% that is applicable to other Russia companies under the anti-dumping measures imposed on PA6.

The MOFCOM Announcement No.14 of 2017 - Announcement on Public Joint Stock Company KuibyshevAzot Inheriting the Anti-dumping Duty Rate under the Anti-dumping Measures Imposed on Polyamide-6 Granula will take effect as of March 16, 2017.
