Ministry of Commerce of PRC Holds Convention on Mediation and Opening-up Forum in Shanghai

On November 6^th, the Ministry of Commerce of PRC holds Forum on United Nations Convention on International Settlement Agreements Resulting from Mediation and China’s Opening-up in Shanghai, which is a supporting activity of China International Import Expo (CIIE). Mr. LI Chenggang, Assistant Minister of Commerce of PRC attended the Forum and delivered a keynote speech. Among the attendees are LUO Dongchuan, Vice President of the Supreme People’s Court of the People’s Republic of China and Ms. Anna Joubin-Bret, Secretary of the United Nations Commission on International Trade Law (UNCITRAL).

During the panel session, centered on United Nations Convention on International Settlement Agreements Resulting from Mediation and China’s opening-up, two groups of guests had discussions on a series of hotly debated topics including the historical evolution of commercial mediation, the content of convention on mediation, the relationship between the convention on mediation and business environment, the influence of convention on mediation over the international commercial dispute settlement mechanism and the connectivity of convention on mediation with domestic laws.

In June，the 51^th Session of the United Nations Commission on International Trade Law passed the draft of United Nations Convention on International Settlement Agreements Resulting from Mediation, and submitted it to the 73^rd Session of the UN General Assembly for deliberation and approval. The Convention aims at resolving issues arising from the cross-border implementation of international commercial disputes settlement agreements resulting from mediation and trailblaze a new path to diverse solutions to commercial disputes. It will contribute to the improvement of business environment for states parties, import-export trade and investment cooperation.

Among other participants are representatives from official departments like Foreign Affairs Committee of the National People's Congress, the Supreme People’s Court of PRC and the Ministry, from practice field like China International Economic and Trade Arbitration Commission, important commercial disputes settlement organizations at home and abroad and reputed law firms, as well as business leaders and scholars in the field.
